Privacy policy

Last updated: 18 October 2026

You gave us your email address and a delivery address, not your life story. We try to treat the information you do share accordingly. This policy explains what we collect, why, who sees it, and what you can do about it.

1. Who we are

This website, drinkoffpeak.com, is operated by Off Peak Performance Pty Ltd (ACN 686 455 498, ABN 12 686 455 498), trading as Off Peak ("Off Peak", "we", "us"). We're based in Victoria, Australia.

We handle personal information in line with the Privacy Act 1988 (Cth) and the Australian Privacy Principles (APPs), and in line with the Spam Act 2003 (Cth) when we send marketing messages. In this policy, "personal information" means information about an identifiable individual.

2. What we collect

Depending on how you deal with us, we collect:

  • Contact and delivery details: your name, email address, phone number, and delivery and billing addresses.
  • Order details: what you've bought, prices paid, discount codes used, delivery status and order history.
  • Subscription details: your subscription products, delivery frequency, renewal dates, and skipped, paused or cancelled deliveries.
  • Payment details: your payment method is handled by Shopify Payments and the other payment providers we enable at checkout. We don't see or store your full card number. We may receive limited information, such as the card type, the last four digits, the payment status, and any refund details.
  • Communications: emails, messages and support requests you send us, and our replies.
  • Marketing preferences: whether you've subscribed to our emails or SMS, when and how you did, and when you unsubscribed.
  • Reviews and content: reviews, photos and posts you give us or publicly tag us in.
  • Website and device data: your IP address, browser and device type, pages visited, products viewed, items added to your cart, referring website or ad, and approximate location. We collect these through cookies and similar technologies.
  • Referral and code data: the discount code you used and the creator, partner or venue link that led you to us.
  • Business contact details: if you're a stockist, supplier, creator or other business contact, we collect your business and contact details and records of our dealings.

We don't ask for sensitive information, such as health information, and you don't need to give us any to order. If you volunteer it in a message, we'll use it only to help with your request.

3. How we collect it

We collect most information directly from you: when you order, subscribe, sign up for emails or SMS, enter a competition or offer, write a review, or contact us. We also collect it automatically from your browser or device when you visit the Website, and from the platforms and partners we use to run the business, such as Shopify, our subscription and email tools, our carriers, and social media platforms when you interact with our ads or pages.

4. Why we collect and use it

We use personal information to:

  • Process, fulfil and deliver your orders, and manage subscriptions and renewals.
  • Take payments, issue refunds and prevent fraud.
  • Respond to your questions, faults, claims and complaints.
  • Send order and delivery updates, and subscription renewal reminders.
  • Send you marketing emails or SMS, but only if you've agreed to receive them.
  • Show our ads on social platforms and measure how well they work.
  • Understand how people use the Website and improve our products, service and Website.
  • Display reviews, run promotions and pay creator or venue referral commissions.
  • Meet our legal, tax, accounting and regulatory obligations, and handle disputes.

We don't sell your personal information.

5. Marketing emails and SMS

We only send you marketing emails or SMS if you've given us consent, for example by ticking a box, entering your details on a sign-up form, or replying to opt in. Placing an order doesn't automatically sign you up to marketing unless you tick a box that says so.

Every marketing message identifies us and tells you how to unsubscribe. Click the unsubscribe link, reply STOP to an SMS, or email hello@drinkoffpeak.com. We'll action your request as soon as we can and within 5 business days. You'll still get messages we have to send, like order confirmations, delivery updates and subscription notices.

6. Who we share information with

We share personal information with service providers who help us run Off Peak, but only what they need for their role:

  • Shopify, which hosts our store and runs checkout, payments and fraud analysis. If you use Shop Pay or another checkout provider, its own privacy policy also applies to the information you give it.
  • Subscription provider (Appstle), which manages recurring orders, renewals and customer notifications.
  • Email and SMS provider (Klaviyo), which stores marketing contact lists and sends our emails and SMS.
  • Review provider (Judge.me), which collects and displays product reviews and may send review requests.
  • Meta, through the Meta pixel on our Website, which receives information such as page views, add-to-cart events and purchases to measure and target our advertising.
  • Analytics and advertising tools. If we turn on other analytics or advertising tools, such as Google tools, we'll list them here.
  • Carriers and fulfilment partners, such as Australia Post and our warehouse and shipping partner, who need your name, address, phone number and order details to deliver your order.
  • Creators, partners and venues that refer customers to us. We give them results linked to a code or link, such as the number of orders, and not your personal details.
  • Professional advisers and insurers, such as accountants, lawyers and auditors.
  • Government and regulators, where the law requires or allows it, and anyone you ask us to share with.
  • A buyer of the business, if Off Peak is ever sold or restructured, subject to the same privacy protections.

We require our providers to handle information securely and only for the services they provide to us. Some providers, such as Meta, also use information for their own purposes under their own privacy policies, which you can read on their websites.

7. Overseas disclosure

Many of these providers store or process data outside Australia. Based on our current providers, information is likely to be disclosed to recipients in the United States, Canada, Singapore and the United Kingdom, and it may also be processed in other countries where those providers operate. We take reasonable steps to make sure overseas recipients handle your information in line with the APPs, but they're also subject to the laws of those countries.

8. Cookies and similar technologies

We and our providers use cookies, pixels and similar technologies to keep your cart working, remember your preferences, measure site traffic, understand which ads and links brought you to us, and show our ads on other platforms. Some of these are necessary for the Website to work. Others measure and advertise.

You can block or delete cookies in your browser settings, and manage ad personalisation in your Meta account ad settings. Blocking cookies may stop parts of the Website from working properly, including your cart and checkout.

9. Automated tools

Some of our tools make routine decisions automatically. For example, Shopify's fraud analysis may flag or hold an order for review, our subscription system charges and schedules renewals according to your settings, and our email tools group contacts and personalise messages according to what you've bought or clicked. We don't use these tools to make decisions that significantly affect your legal rights without a person at Off Peak being able to review them. If you think an automated step has got something wrong, such as a held order or an unexpected message, contact us and we'll check it.

10. Keeping your information safe

We take reasonable steps to protect personal information from misuse, interference, loss and unauthorised access, modification or disclosure. We use reputable platforms with security controls, limit access to people who need it, and review the tools we use. No system is completely secure. If we have a data breach that is likely to cause serious harm, we'll notify you and the Office of the Australian Information Commissioner as required by law.

11. How long we keep it

We keep personal information for as long as we need it for the purposes in this policy, including running your subscription, dealing with claims and meeting legal obligations. Tax and accounting records generally have to be kept for several years, so we keep order records for the required period. We review and clear out inactive marketing contacts from time to time. When we no longer need information, we take reasonable steps to destroy or de-identify it.

12. Access, correction and deletion

You can ask to see the personal information we hold about you, ask us to correct it, or ask us to delete it. Email hello@drinkoffpeak.com. We may need to confirm your identity before we release or change anything, and we'll reply within 30 days. We can't delete information we're legally required to keep, such as tax records, but we'll tell you if that's the case.

To stop marketing, use the unsubscribe link or contact us. You can also ask us to stop sharing your information for advertising.

13. Complaints

If you think we've mishandled your personal information, email hello@drinkoffpeak.com with the details. We'll acknowledge your complaint, investigate it, and reply in writing, usually within 30 days.

If you're not satisfied, you can complain to the Office of the Australian Information Commissioner (OAIC) at oaic.gov.au or on 1300 363 992.

14. Children

Our Website and products are intended for adults. We don't knowingly collect personal information from anyone under 18. If you think a child has given us personal information, contact us and we'll delete it.

15. Changes to this policy

We'll update this policy when our practices, providers or the law change. The latest version will always be on this page with a revised "last updated" date.
